(continued) <br />Keep in mind that the residential use of our property <br />existed before any marina operations (Chaska's, North <br />Star's, or others before that). Our property was rezoned <br />to commercial use over the objections of our parents <br />several years ago; we are now dealing with that legacy. <br />V/e dispute your statement that good fences make good <br />neighbors. Good fences are merely reminders to those <br />who need something obvious that says keep out. <br />Conclusion: <br />1. Appropriate fencing and screening and control of Karina <br />employees and customers have been discussed at length at <br />past marina committee and council meetings and with Mr. <br />Dunn (as well as with Mr. Pauley when he was involved). <br />These are the marina's responsibility. If there were not <br />marina operations on both sides of us, the necessity of <br />screening, fencing, and customer control would be a dead <br />issue. <br />2. We are opposed to a variance request that would decrease <br />the prescribed side setbacks, either on the land or in the <br />water. <br />3. We will not consider any changes to accommodate joint water <br />front use; that could only lead to more encroachment. <br />4. We only ask that the marina and its personnel operate in a <br />manner (and within the law) that does not infringe on the <br />enjoyment of our property. And when infringement occurs, <br />it will be met with appropriate action.
