i <br />Zoning File #852 <br />July 9, 1985 <br />Page 5 <br />Staff would add another item in this review process and that is <br />required review by other agencies concerned with water quality and <br />water quantity matters that do not require permits such as the U.S. <br />Soils Office and Dr. Hanson of the F.W.B.I. Please review their <br />comments in Exhibit D and E. <br />you make any decision on this application# please review <br />the CMP sections referred to above or any other sections you find <br />Pertinent to this review — bring them up at our meeting. How does <br />this project stand in consideration of the appropriate Environmental <br />Protection Goals noted on page CMP 3-18? What kinds of precedents do <br />we establish if we find application is acceptable because it meets the <br />standards established for this review? Would you approve the altera­ <br />tion of another wetlands area within this watershed in 1986? Would <br />this project qualify as a test case for the City? The findings made <br />from the controlled monitory of water quality would assist the City in <br />future applications. <br />Staff would recommend that the application can only be approved <br />as a test case and that monitoring take place for an unlimited period <br />of time until the City, F.W.B.I. and possibly the U.S. Soils Office <br />agree that under all possible conditions observed at various inter­ <br />vals, the water quality at the point drainage enters the Lake has not <br />been worsened by alteration. The applicants in turn would have to <br />agree to respond within a reasonable amount of time to any request for <br />physical alteration of any of the improvements if those improvements <br />have been found to have detrimental effects on the environment or <br />water quality. <br />The City would be looking for the following from the applicant: <br />a) Developer's Agreement - <br />1. Completion of work at approved time periods <br />2. Posting of appropriate security so that City can step in <br />and complete if necessary or situation is deemed an <br />emergency. <br />3. Payment of fees for the many inspection.; to be made by <br />Orono staff during construction period. <br />4. Applicant to hire outside agency to perform wat(*r tests <br />per City's monitoring schedule. <br />5. Written confirmation by applicants that F.W.B.I. and <br />U.S. Soils Office may perform required tests on site. <br />b) No use of chemical agents in control of algae and aquatic <br />vegetation. In addition the City will ask that all use of <br />fertilizers, hericides and pesticides in areas adjacent to ponds <br />J
