#927 Stanley Gregory <br />Page 2 <br />June 12, 1985 <br />In an earlier application, the applicant was granted a side setback <br />variance from the caretaker house of 10 feet rather than the minimum of <br />20 feet to provide the right location for the proposed principal <br />structure. <br />In the applicant's addendum, we are advised of a future plan to build a <br />greenhouse with an 8 ' to 9 ' width between the lakeside of the garage and <br />the pool. If the sketch submitted for the applicant is accurate, <br />there would be no 10 feet separation as required because the pool is 10 <br />feet from the garage. If we are asked to also consider the greenhouse, <br />the pool would have to be placed 44 feet from the lakeshore. Exhibit E <br />shows an LP gas line running under proposed pool location. <br />The applicant has asked if consideration can be given for the abundant <br />land area to the north and east of the hou!>e that will not be developed. <br />In review of the hardcover calculations (Exhibit D), it would appear <br />that hardcover is not a problem out of the 75 foot setback.zone. <br />The City has given such consideration in a previous application where <br />the applicaht had exceeded the allowed hardcover within thf» 75-250' <br />setback area; but because the applicant was willing to limit hardcover <br />within the 250-500' setback area in addition to removing an old <br />boathouse within the 75* setback area, the hardcover variance was <br />granted. What kind of tradeoffs are viable in the case of increased <br />hardcover within the 75' setback area for new construction? <br />1. Replace all de<;ignated paved area within the 75* <br />setback area with natural ground cover. <br />2. Place a limit on all paving around the pool edf.a that is <br />located within the 75' setback area. <br />3. No portion of the pool located within the 75' setbak <br />area can be higher than fi 'ished natural grade. <br />Advise applicant that DNR must approve all setback <br />variances for structures that encroach within 50 feet <br />of Lake Minnetonka--applicant must reconsider plan for <br />greenhouse or relocate pool. <br />Issues to be addressed in the review: <br />1.What kinds of acceptable hardships have been cited to <br />permit approval of this variance? Steep topography <br />along lakeshore--narrowness of lot at west end— <br />location of caretaker's house. <br />2. Are there other feasible locations for the pool located <br />out of the 75 foot setback area? <br />3.Is the need for the variance duo to circumstances unique <br />to the subject property or were these circumstances <br />created by the applicant? <br />■Am*....
