Applicant advised that it was done
last fall and no one from the City had advised him of the need for a
conditional use permit.
The pond of approxi niat e 1 y 10,000 sf in area is not located within a
designated wetland. The fjond will serve as a collector basin for all
runoff froma small local i zed watershed--house to south, front yardof
Schultze house and area to the immediate north (see Exhibit D). The
pond will not change or redirect the previous drainage patterns nor
iiave any negative effects on surrounding properties. The pond will
slow runoff to the west from the Schultze property..
As the applicant has advised, the runoff has created a problem in his
rear yard because of new construction on property to south and the
velocity of runoff froni tennis court; it becamie very necessary to
define a retention area in the yard. Schultze advi ses that the area of
the pond was always damp and would be useless as yard area.
The pond is decorat i ve and will not f unction as a wi Idl i f c* por^*,*Thus no
need fc>i DNli review. The vaitershed is localized on this property and
does not qualify for watershed review.
