#912 Hcdlund <br />Page 3 <br />May 8, 1985 <br />In the half-acre zone, the Counci l has granted approval <br />to rebuild on lots from 6,237 - 11,296 square feet where <br />there was an existing house, and the owner had a <br />substantial property right based on the existing <br />structure. The smallest vacant lot approved for a <br />building site in the half-acre zone was 12,870 square <br />feet. <br />Based on the above factors, you have two options for recomir.endation: <br />Denial based on the following findings: <br />1. Lot docs not follow the neighborhood pattern of <br />existing development, being smaller tnan 91% of the <br />developed lots within 1000' of the property. <br />2. Relatively unsafe county road access. <br />3. Applicant had forewarning that lots may be unbuildable <br />prior to his purchase. <br />4. Denial is consistent with past denials on vacant <br />substandard lots of this size. <br />5. Property could be combined with adjacent properties to <br />the east or south, both of which are substandard in <br />area. <br />6. Intent of the application is contrary to the letter and <br />intent of the Orono Comprehensive Plan. <br />7 . Granting of the var iance would set an . dverse precedent <br />in the City. <br />6. The property falls too short of the zoning standards to <br />justify granting of the variance. <br />Approve 1 based on the following findings; <br />1. A structure previously existed on the property. <br />2. Sewer is available and has been assessed to the <br />property. <br />3. No other land is available to combine with the <br />parcels. <br />4. Proposed structure can meet all required setbacks and <br />hardcover requirements.
