SUBDIVISIONS <br />B) <br />C) <br />iiv& <br />No land shall be subdivided which is held unsuitable by tne City for <br />the proposed use because of flooding, inadequate drainage, soil and <br />rock formations with severe limitations for development, severe <br />erosion potential, urifavorable topography, inadequate water supply or <br />sewage treatment capabilities, or any other feature likely to be <br />harmful to the health, safety, or welfare of future residents of the <br />proposed subdivision or of the community. <br />Copies of all plats within the shoreland overlay district shall be <br />submitted to the Commissioner of Natural Resources within ten (10) <br />days of final approval by the City. <br />Planned Unit Development (PUD). Altered zoning standards may oe <br />allowed as exceptions to tnis ordinance for PUD'S provided <br />preliminary plans are approved by the Cofiunissioner of Natural <br />Resources prior to their approval by tne City, ana further provided: <br />1.Central sewage facilities shall be installed wnich meet <br />applicable standards of the Minnesota Pollution Control Agency <br />or the PUD is connected to a municipal sanitary sewer. <br />2.Open space is preserved tnrough tne use of restrictive aeea <br />covenants, public dedications, or otner nietfiocs. <br />3.The following factors are carefully evaluated to ensure the <br />increased density of development is consistent witn tne resource <br />limitations of the protected water: <br />a <br />b <br />c) <br />d) <br />e) <br />f) <br />suitability of the site for tne proposed use; <br />physical and aesthetic impact of increased density; <br />level of current development; <br />amount and ownership of undeveloped shoreland; <br />levels and types of water surface use ana public accesses; <br />possible effects on over-all public use. <br />4.Any commercial, recreational, community, or religious facility <br />allowed as part of the planned unit development shall confcrni to <br />all applicable federal and state regulations including, but not <br />limited to the following: <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />licensing provisions or procedures; <br />waste disposal regulations; <br />water supply regulations; <br />building codes; <br />safety regulations; <br />regulations concerning the appropriation and use of <br />Protected Waters as defined in Minnesota Statutes 1974 <br />Chapter lOb; and <br />applicable regulations of the Minnesota Environn.ental <br />duality Board. <br />.,.o
