Zoning File #1563 <br />July 13, 1990 <br />Page 3 <br />Staff has met with the applicant on site and has reviewed <br />the proposed improvements in relation to existing mature trees. <br />It would appear that only 1 tree shall be removed as a result of <br />these improvements and it would appear to be a tree that hangs <br />dangerously low over the existing residence. <br />Review Exhibits F & I, a drainfield proposed to handle <br />drainage from walkout basement door at south side. Detailed <br />plans of drainfield must be provided with building plans at time <br />of application for building permit. <br />There is a concrete block wall that has been placed right on <br />the shared lot lines of the property. The wall is in a serious <br />state of disrepair. The applicant has advised that they have no <br />plans to replace the walls that have already fallen adjacent to <br />the house. It is not the City's intention to get in the middle <br />of a potential dispute between the neighbors nor do we wish to <br />create one. The hardcover facts did not include the partial <br />encroachment of the wall into the applicants property nor was the <br />improved overhang included as it did not exceed a 1 1/2' width. <br />An additional 125.8 s.f. of hardcover is proposed as a result of <br />the improvement. Please review Exhibit A-1, applicant's comments <br />on the hardcover issue. <br />Options of Action <br />Denial - If denied, please refer to the necessary findings <br />in the variance sections of your code. <br />Approval - If approved, the following findings and hardships <br />may be considered: <br />1. There are no additional lands available to acquire. <br />Applicant does have the benefit of a non-hardcover area <br />located within the 50' unimproved right-of-way adjacent to <br />the property. <br />2. The improvements appear consistent with the recent <br />upgrades of the properties within the neighborhood. <br />3. The following conditions may be considered by the <br />Planning Commission in their recommendation: <br />4 <br />a. Proposed hardcover cannot exceed the level of <br />existing hardcover at 31%. Applicant must agree to <br />remove 125.8 s.f. or 1.49% of existing hardcover. <br />b. Applicant to redesign staircase from lakeshore <br />deck so that there is no encroachment of the average <br />lakeshore setback line. <br />c. Any others deemed appropriate by the Planning <br />Commission.
