Zoning File #1557 <br />July 10, 1990 <br />Page 2 of 2 <br />Discussion ~ <br />The applicants proposes to construct a pool of 596 s.f. <br />water surface area, with additional patio and decks. The pool is <br />proposed at grade level at the lakeside of the house, hence the <br />actual degree of lakeview encroachment will be minimized. Due to <br />the angling of the houses in the neighborhood, the adjacent <br />residence to the north at 2690 Pheasant Road will be the most <br />affected. <br />The 74' average lakeshore setback encroachment would be <br />perhaps typical of any of the houses along this street that <br />wished to construct a pool. The typical lot widths of 100' tend <br />to mitigate the impact of pools or other improvements in the <br />lakeshore yards. Also note that the proposed pool at its closest <br />point is 125' from the normal shoreline, hence this house and <br />most of those in the neighborhood have unusually deep lakeshore <br />yards. <br />Applicant proposes to remove whatever plastic exists under <br />decorative rock beds on the property. The applicant's surveyor <br />has assumed that all such beds on the property are underlain by <br />plastic, although he has not verifie" that. Such removals would <br />result in an actual decrease in hardcover to nearly the 25% <br />standard. However, the only other possible hardcover removals <br />witheut starting to remove structure, would be in the sidewalk or <br />driveway area which are established and functional improvements <br />on this property. <br />The boat house on the property is considered as a non- <br />conforming structure, and is subject to the ordinances pertaining <br />to such structures. Generally, those ordinances allow non- <br />structural repair and maintenance (reroofing, residing, painting, <br />etc.) but would not allow replacement of the structure it it was <br />destroyed or became structurally unsound due to aging or other <br />deterioration. <br />Staff Reconmendation - <br />Planning Commission should address the issues of hardcover <br />and make a recommendation as to whether the proposed degree of <br />removals is acceptable. Planning Commission should further <br />determine whether existing lakeviews enjoyed by neighboring <br />property owners are adversely affected. Any recommendation for <br />approval should specify the hardships and justifications for <br />granting of the requested variances.
