Richard Zuckman, 3995 North Shore Drive <br />Subdivision/Sketch Plan <br />Zoning District - LR-IC <br />Total Area = 57,247 s.f. or 1.314 acres <br />Pertinent Ordinances - <br />1. Section 10.25, Subdivision 4 (A) - In the LR-IC zoning <br />district, detached dwelling units are encouraged in PRD <br />developments. <br />2. Section 10.25, Subdivision 6 (B) - LR-IC district requires <br />21,780 s.f. or .5 acres; proposed density = 14,311.75 s.f. <br />or .33 acres per unit. <br />3. Section 10.32 - PRD ordinances. <br />A) Specifically, Subdivision 2. LR-IC PRDs do not <br />provide for additional units because of PRD <br />development. The ordinance specifically says "dwelling <br />units shall not exceed the number of such lots or units <br />permissible under the minimum lot size requirements of <br />the zoning district. <br />B) Subdivision 3 - Council discretion "dwelling units <br />may be, at the descretion of the Council and subject to <br />the conditions set forth by the Council, in detached, <br />attached or multi-family dwelling structures; subject <br />to the limitations provided for in each zoning <br />district." This section suggests that Council is the <br />only body that may consider special requests for <br />additional dwelling units but these additional units <br />would be subject to all other pertinent limitations <br />provided for in each zoning district. <br />4. Section 10.60, Subdivision 2 - Density. This specific <br />section limits density to no greater than 4 dwelling units <br />per acre no matter what density credit an application may <br />seek (i.e. credit for wetlands in sewered areas, duplex, <br />etc.).
