CITY <br />. OF <br />ORONQ <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _ _^16 <br />NOW, THEREFORE BE IT RESOLVED, that based upon cne or <br />more of th6 findings noted above# the City Council of the Ci^y of <br />Orono hereby approves the preliminary plat for Carol J. Kelly at <br />the property located at 3020 Casco Point Road per the survey <br />originally dated 5/21/90, revised 6/4/90 by Pete J. Knabb of Ron <br />Krueger & Associates, Inc., subject to the following conditions: <br />1. The following improvements must be completed prior to <br />final plat approval: <br />a) Realignment of drainage ditch as shown on survey <br />noted above. <br />b) Removal of 923 square feet of existing hardcover on <br />proposed Lot 1 as shown on the survey noted above <br />(revised date 6/4/90). <br />2. Upon application for a building permit for new <br />construction on Lot 2, the future owner shall pay the <br />following sewer and water fees: <br />Sewer unit charge <br />Water unit charge <br />$1,513.86 <br />1,691.78 <br />It should also be noted that this rate is based on the 1990 <br />fee schedule and will be adjusted based on the inflationary <br />rate for each annual fee schedule. <br />3. The subdivider shall execute a restrictive covenant to <br />be drafted by the City to be filed against the chain of <br />titles of Lots 1 and 2 denying all riparian access and use <br />of the lake via Lot 1 by Lot 2 of this subdivision. <br />4. Current and future owner of Lot 1 is hereby advised that <br />hardcover within the 75 “250' setback area is at maximum <br />allowed level at 25%. Any additional improvements to this <br />property resulting in increases in hardcover must be <br />approved by the City of Orono and may result in equal or <br />greater removal of existing hardcover. <br />Page 2 of 4 <br />J
