r;T <br />RQKfO^ <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2816 _________ <br />A RESOLUTION GRANTING <br />PRELIMINARY APPROVAL OP A <br />PLAT AT 3020 CASCO POINT ROAD <br />PILE NO. 1531 <br />WHEREAS, Carol J. Kelly on April 21, 1990 filed a <br />formal subdivision application with the City for approval of a 2- <br />lot residential plat of property legally described as Tract T, <br />Registered Land Survey #461, Files of the Registrar of Titles, <br />Hennepin County, Minnesota, (hereinafter "the property") and; <br />WHEREAS, after due published and mailed notice in <br />accordance with Minnesota Statues 462.358 et. seg. and the City <br />of Orono Zoning and Platting Codes, the Orono Planning <br />Commission held a public hearing on May 21, 1990 at which times <br />all persons desiring to be heard concerning this application v/ere <br />given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on June 11, 1990 <br />the Orono City Council considered the subdivision application of <br />the Carol J. Kelly (hereinafter the "subdivider"), noting the <br />following findings of fact; <br />1. The property is located within the LR"1C Single Family <br />Lakeshore Residential Zoning District requiring a minimum of <br />1/2 acre of contiguous dry buildable land within each newly <br />created lot. <br />2. The property contains a total of approximately 1.09 <br />acres, all of which is considered dry buildable land. <br />3. The proposed plat contains 2 lots meeting the required <br />1/2 acre dry contiguous lot area requirement. <br />4. Each lot meets the required lot width to the rear of the <br />front yard setback line at 30': <br />Lot 1 - the only legally recognized riparian lot meets <br />the required lot width of 100' at the 75' lakeshore <br />setback line. <br />5. Each lot can be residentially developed without the need <br />for variances to the LR-IC standards. <br />6. The existing structural improvements on Lot 1 meet the <br />required setback from the newly proposed division line. <br />Page 1 of 4
