The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staf f, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on thi3 property are pocu 1 iar to i t and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a coi'-venience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would bo in keeping with the spirit and intent of the Zoning Code and Corprohensivc Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to the Municipal Zoning Code Section 10.22, Subdivision 2 to permit the const ruction of a deck which will increase hardcover in the 75-250 ' setback zone f rom 6,898 square feet (or 24% ) to 8,044 square feet or (29*) wher*' only 7,018 sqviare feet (25%) is allowed, subject to the following conditions: 1. The h.irdcovcr allowed by this variance is in excess of th*^ 25p»?rcenr allowed in the 75 — 250 * foot setback zone.
