In fact, the only visible signs of a <br />commercial operation were the 3 trucks parked in the <br />driveway and the unique terraced gardens within the <br />east yard. It should also be noted that at the time <br />the 1985 conditional use permit was issued, a home <br />occupation was a permitted accessory use requiring no <br />license review. It may be appropriate for the <br />applicant to apply for a home occupation license. <br />Issues for Consideration ~ <br />Is the terraced garden area acceptable in its present <br />configuration? Is the sale of the plantings from those gardens <br />objectionable? - Has it increased the commercial use of the <br />property to an unacceptable level? <br />Does this garden function as a seasonal greenhouse requiring <br />approval of an expansion of the original conditional use permit <br />for greenhouse use? Based on applicant's response to greenhouse <br />addition to rear of detached garage, how does the greenhouse <br />addition affect the original conditional use permit for <br />greenhouse use? Has the intensification of landscape use of the <br />residential property affected the original approved home <br />occupation? <br />Options of Action - <br />A. Conditional use permit and variance (setback/height of <br />retaining walls in front yard) for land alterations <br />involving installation of retaining walls: <br />1. Denial, requiring removal - recommendation date for <br />complete restoration to original state. <br />2. Conditional approval - allow retaining walls to <br />remain but all walls in excess of 3 1/2' in height to <br />be reduced or remove portions of terraced gardens to <br />lessen commercial lock/use. <br />3. Approval as submitted. <br />B. Conditional use permit for nursery/crop use and variance to <br />required 10 acre in area standard: <br />1. Denial - all sale of plantings to cease. In the <br />future such gardens to be defined and used as a <br />permitted accessory use.
