Zoning File #1508 <br />April 12, 1990 <br />Page 3 of 4 <br />Discussion ~ <br />Given the nature of the existing garage and canopy, and Its <br />location near a lot line and between the house and the street, <br />staff would recommend that this structure not be allowed for <br />housing of animals, either on a temporary or a permanent basis. <br />The structure is in such condition that the applicant has in the <br />past approached staff about tearing it down and rebuilding on the <br />same foundation. He has been told this would require variances. <br />There would appear to be adequate area in which to construct a <br />barn or loafing shed that meets all setback and location <br />requirements. <br />The applicant has not suggested whether he would revise the <br />fenced pasture areas. Nothing in the code prohibits him from <br />using additional areas anywhere on the property for pasture. <br />As of this writing, staff has received no comments from <br />neighboring property owners regarding the application. <br />Note that the boundary between the LR-IA and RR-lB districts <br />follows the west property boundary. That boundary was defined <br />along the quarter section line when the zoning districts were <br />layed out in 1975. The property is located approximately 900' <br />from the dredged channel abutting North Arm, and approximately <br />1,800' from the lake proper. Hardcover and runoff to the lake <br />are not significant factors in the application. <br />Staff Recomnendation - <br />Absent any comments from neighboring property owners, staff <br />would recommend approval of the conditional use permit to keep up <br />to 2 horses on the property, finding that the lot has adequate <br />acreage, and finding that a suitable structure for housing of the <br />proposed horses can be constructed to meet all required setbacks, <br />as follows: <br />75' from all property lines; <br />150' from any neighboring residence structure; <br />no closer to North Arm Drive than the existing residence <br />structure on the property. <br />A diagram indicating the allowable locations is attached as <br />Exhibit F. <br />1. <br />2. <br />3.
