The survey indicates that the fenced "corral” area is <br />approximately 5' from the west lot line» 10' from the north <br />lot line, and about 25'-30' from the east lot line abutting <br />North Arm Lane. The code does not require a lot line <br />setback for such a pasture area. <br />5. If applicant constructs a new accessory building to house <br />horses, such a building could easily meet the necessary 75' <br />setbacks from lot lines and 150' setbacks from existing <br />neighboring residences. All existing neighboring residences <br />are 150' or more from applicant's lot lines. <br />6. Applicant has noted that until such future time that a horse <br />barn is constructed, there would not necessarily be a fully <br />enclosed horse shelter constructed. Prom discussions with <br />the applicant, staff concludes that the applicant's plans <br />may include temporary housing of horses in the existing <br />canopied area attached to the garage on the property, south <br />of the house. <br />This structure consists of a 20x28' garage and adjacent <br />28x25' canopy, located 24' from the west lot line and <br />approximately 225' from the adjacent residence structure to <br />the west. However, this garage and attached canopy also are <br />located closer to the street than applicant's residence and <br />staff would make the interpretation based on Section 10.03, <br />Subdivision 9 (D), that any modification to this existing <br />structure will require a separate variance application. <br />Note also that the garage structure is 581 square feet, with <br />the canopy being 713 square feet for a total of 1,294 square <br />feet. Enclosure of the canopy area would make this an <br />oversized accessory structure, and would therefore also <br />require execution of the required covenant per the recently <br />amended accessory structures ordinance. At 5+ acres, this <br />property would be allowed, via the accessory structure <br />ordinance conditions, 1 accessory structure up to 2,200 <br />square feet, and additional other accessory structures <br />totalling no more than an additional 2,200 square feet. <br />Therefore, should the applicant wish to construct a separate <br />horse barn or loafing shed near the pasture area, it woul <br />appear very feasible to do so. <br />7. The applicant has suggested for the first few years, horses <br />might be only kept on the property during the summer, hence <br />construction of a permanent barn that meets all code <br />requirements might not occur for a while.
