u <br />EXHIBIT * 4 <br />A DENIAL OF THIS REQUEST VIOLATES MY CIVIL AND CONSTITUTIONAL RIGHTS <br />I:. the past few years numerous property owners have received permits <br />to expand existing homes and build new homes on sub -standard lots in <br />the area in which I live: <br />Next door to me there are three single family residenses on a 75' <br />lot - the owner was given a permit to add more living space <br />and hardcover. <br />Down the street a few houses, a new house just went up on a 60' <br />lot and next door to that a sidelot setback of 3.1' was OK. <br />There are literally dozens of these situations recorded in Orono since <br />the new zoning codes went into effect in 1975. Why? Because the City <br />Council, in a defensive move to counter an IDS initiative to build <br />high density housing in the Navarre area adopted overly stringent <br />zoning laws in the area. Width: Area: <br />Resolution <br />* <br />1246 <br />40% <br />10% <br />Resolution <br />* <br />1246 <br />40% <br />7% <br />Resolution <br />* <br />1719 <br />45% <br />23% <br />Resolution <br />* <br />1670 <br />29% <br />40% <br />Resolution <br />* <br />1718 <br />39% <br />31% <br />Setback: <br />15%/40% <br />Staff, in considering an application in the Shady -wood flat, stated: <br />"staff would suggest that minimum realistic lakeshore lot sizes in <br />LR-IC range from 55% to 75% of 1/2 acre" or .27 to .37 acres. <br />In summary, almost all the remodeling and building permits issued in <br />the area I live in were granted using a variety of variances, <br />variances in lot width, areas, setbacks, hardcover, etc. <br />To deny me the same consideration and freedoms is arbitrary, capricious <br />and wrongful, a deliberate abuse of discretionary power, resL:lting in <br />an unnecessary hardship and inequitable treatment. <br />
