i <br />EXHIBIT * 3 <br />VARIANCES VIA INDIVIDUAL LOT MERIT - LOTS IN SEWERED AREAS <br />There exists numerous zoning file cases that evidence the Council's <br />meticulous and judicious application of the zoning standards but one <br />stands out as being recent and similar to the current application. <br />By resolution * 1719 granting the following variances to municipal <br />zoning code section 10.25, subdivision 6 (B) the council appeared to <br />establish the reasonable procedure of approving lots on individual <br />merit. It approved lots that (1) were at least 55' in width and (2) <br />were 77% of the required square footage, and (3) were in severed LR-IC <br />single family lakeshore residential zoning districts. <br />The Council noted uniquely important. detail such as the property is <br />consistent in area with other developed lots and approximates the <br />narrowest lots in the neighborhood. <br />In summary, the Council acted on the following Planning Commission <br />findings: <br />a) No available land on either side of property. <br />b) The property is sewered and watered. <br />c ) Additional •!ari ar,ces would not be needed. <br />d) No negative effects on public health, safety, and welfare. <br />e) The varian a is consistent with the area's development. <br />f) No future need for hardcover and setback variances. <br />g) The conditions of the land in question are peculiar to such <br />property or immediately adjoining property. <br />h) The conditions do not apply generally to other land in district. <br />i) Granting of the application is necessary for the preservation and <br />enjoyment of a substantial property right of the applicant. <br />j) Granting the variances will not in anyway impair the health, <br />safety, comfort, morals, or in any other respect be contrary to <br />the intent of the Zoning Code. <br />k) Granting of the proposed variances will not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />demonstrable. hardship or difficulty. <br />The City Council is to be commended for acting in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. Without including unnecessary detail at this point, suffice it <br />to say the Council's Conclusions, Orders and Conditions were appro-- <br />priate1y comprehensive and considered. <br />
