D. <br />Es <br />B. The establishment of any new building for the housing of <br />animals or fowl on such stock farms shall be located 1 5 0 <br />feet from the nearest lot line. <br />Does the Planning Commission feel that minimum area <br />standards should be required for creation of such stock <br />farms, 10, 20, 30 acres. Crop farm, conditional use permit <br />requires minimum of 10 acres. Is the .150 feet setback <br />restrictive enough for a commercial operation. <br />Section 10.03 Subdivision 21 <br />Exception. The requirements of Subdivision 19 are not <br />intended to govern the normal and customary grading in the <br />area of an existing or a newly constructed building, or the. <br />grading of the driveway serving such building, nor to an <br />movement under 100 cubic yards which does not advers ly <br />impact the existing drainage. Such grading and earth moving <br />shall be approved by the Building Inspector at the time of <br />issuance of the building permit, providing tha- a plan <br />showing property drainage and protection of adjoining <br />property has been submitted. Any unusual earth f i 1 1 ing, <br />removal or grading proposed_ by a builder shall be referred <br />by the Building Inspector to the Planning Commission and the <br />Council for action in accordnance with this Chapter. <br />Normally earth movements of 100 cubic yards or more should <br />be considered unusual. <br />The first underlined section was a staff amendment providing <br />ordinance authority for the land alteration permits issued <br />by staff for the past five years. Note under 100 cubic <br />yards. <br />The last underlined section is suggested by the Planning <br />Commission as a standard for staff to use in determining <br />unusual land movement when reviewing building plans. Staff <br />must advise that every building permit: issued this year or <br />in years past involved the movement of 100+ cubic yards of <br />earth. Driveway construction in rural lots can run 300 to <br />400 cubic yards movements alone. <br />Amend Section 10.22 Subdivision 3 <br />Tree Removal Regulations - no trees within 75 feet of the <br />shoreline with the diameter of six (6) inches or more shall <br />be removed without first obtaining a permit from The City. <br />Such permits shall be issued by City staff provided that <br />at least a like number of replacement trees of a <br />nature and placement acceptab 1 e to the staff are planted, <br />anyquestion envo 1 vine the number of trees to be replaced <br />will require Counci 1 approval. <br />Planning Commission has already approved this amendment, <br />staff has cited it as amendment of Section 10.22. Section 3 <br />instead of listing it as a separate perform :nce standard <br />3 <br />
