As discussed at our last meeting the following section, <br />already approved by Planning Commmi ssion in October, has <br />been amended in order to distinguish between lakeshore lots <br />intersected by roads or corner lots requiring special <br />consideration or review. <br />No detached garage or other accessory building shall be <br />located nearer the front or street lot line than the <br />principal building on that lot except on lots which have <br />frontage on a lake and a rear _yard adjacent to a � treet, <br />accessory buildings located within the street or rear yards <br />of such lots are subject to the setback requirements of <br />Section 10.23, Subdivision 6B, Section 10.24, Subdivision 5B <br />and Section 10.25, Subdivision 6B except that detached <br />garages may be located 10 feet from the street or rear lot <br />line when doors face away from the street and a turn -around <br />is rovid_ed on site. This section shall not apply to <br />lakeshore lots divided by roadways or corner lots._ <br />C. Section 10.03 Subdivision 18 <br />You asked staff to review Section 10.03 Subdivision 18 (A) <br />and (B) in order to determine the need for amending or <br />repealing this section. <br />Crop farms and the keeping of animals for non-commercial <br />purposes are addressed under the respective conditional use <br />permit or accessary use section of the code. <br />The commercial keeping of animals such as that suggested by <br />stock farm use is only addressed in Section 10.03 <br />Subdivision 18A. other levels of commercial uses associated <br />with animals are addressed in proposed amendments dealing <br />with riding acadamies or stables and' barns - public. This <br />section is really not in conflict with the rural zoning <br />sections that allows the non-commercial keeping of animals <br />as an approved accessory use, as was first suggested by <br />staff. Section 10.03 Subdivision 18 deals with the <br />commercial keeping of animals and should remain in the code. <br />Staff recommends the following amendment of Section 10.03 <br />Subdivision 1 8 (A). <br />A. No new "stock farms" shall be created or existing stock <br />farms enlarged more than twenty five percent (2 5 %) with <br />animals over one year old except under the provisions of a <br />conditional use perm, t. In considering any such permit, the <br />maximum number and type of animals to be kept shall be <br />determined by the Council. The site design and method of <br />operation shall be reviewed 3T) j the Council shall find that <br />the proposed or exist inch "stock Farm" will not in its <br />opinion be detrimental to the public safety and the general <br />welfare. <br />E <br />
