Due <br />to the location of the home to the east, <br />the deck, a portion of the applicants’ <br />home, is lakeward of the average <br />lakeshore setback line. They wish to <br />construct a new, rectangular deck with a <br />reduced setback from the lake (shown in <br />red). The new deck will be approximately <br />100 square feet larger than the existing. <br />The existing circular deck is situated <br />approximately 101 feet from the ordinary <br />high water level (OHWL); the proposed <br />deck will be 103 feet from the OHWL. <br />Currently the deck encroaches into the <br />required street setback from Fagerness <br />Point Road; the new deck will resolve this <br />encroachment. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the unique triangular lot <br />configuration as a practical difficulty supporting the requested variance. Additionally, they have <br />provided supporting documentation regarding Practical Difficulties attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Application Summary: The applicant is requesting an average lakeshore setback variance in <br />order to construct a new, reconfigured deck. <br />Staff Recommendation: Planning Department Staff recommends approval.
