MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,June 27,2022 <br /> 6:00 o'clock p.m. <br /> Mayor Walsh stated he will have to wait until the public comment time. <br /> [Continued inaudible yelling.] <br /> Mayor Walsh stated they would take a five minute recess. He resumed the meeting at 6:37 p.m. <br /> Jay Nygard, 1386 Rest Point Road,asked if Mr. Edwards has any plans to deal with the storm water <br /> drainage issue on Rest Point Road that causes water to go onto his property but also onto 1380 and 1390 <br /> Rest Point Road. <br /> Edwards replied they will continue to maintain the system but do not have any projects. <br /> Mr.Nygard clarified there is no plan to fix the storm water drainage on those three properties? <br /> Edwards replied they have no plans to alter the drainage system on that road. <br /> Mr.Nygard is wondering when City storm water will stop entering his property and if there is a plan. <br /> Edwards noted the City assisted Mr.Nygard with how the storm water was entering his property and how <br /> he might fix that. <br /> Mr.Nygard asked how he might fix City storm water entering his property?How he might fix it?It is his <br /> job to fix his property to prevent City storm water from entering? <br /> Edwards replied Mr.Nygard, like any other property owner in the Country has responsibility to maintain <br /> their own property. <br /> Mr.Nygard has explained and shown Edwards City storm water is entering the two houses on the side,he <br /> brought plans to the City,and they have done nothing.He is curious whether there is a plan or if Mr. <br /> Nygard is on his own regarding storm water entering his property. <br /> Edwards noted there are no current plans to alter the storm water system on Mr.Nygard's road. <br /> Mayor Walsh closed the public hearing at 6:40 p.m. <br /> ZONING REPORT <br /> 7. LA22-000028,PETER ESKUCHE WITH ESKUCHE DESIGN,2605 NORTH SHORE <br /> DRIVE,VARIANCES—RESOLUTION NO.7272 <br /> Peter Eskuche,Applicant,was present. <br /> City Planner Oakden noted the Applicant is requesting variances to construct a new house,including a <br /> building,hardcover and retaining walls in the 75 foot lakeyard, a sideyard setback and lot area variance, <br /> as well as a wetland setback and 75 foot lakeyard setback for proposed entrance monuments.The <br /> property has an inlet for Lake Minnetonka that encroaches into the lot establishing the 75 foot setback on <br /> the lakeshore and the inlet.They are proposing to build a new home and replace the existing structure;the <br /> existing home sits forward of the 75 foot setback around 18 feet from Lake Minnetonka. The variance <br /> application was approved on the site in 2019 and has since expired.The Applicant designed a home to <br /> improve the current setbacks in a similar setting as the 2019 proposal, is moving the home further back <br /> from the lakeshore,removing encroaching hardcover,and moving the house closer to the east property <br /> Page 5 of 11 <br />
