AGENDA ITEM
Prepared By: mcc Reviewed By: J. Barnhart Approved By:

1. Purpose. This application is regarding an average lakeshore setback variance to construct additions
on the lake side of the existing home.

2. MN§15.99 Application Deadline. The application was received on February 23, and considered to
be complete on March 7, 2022. Therefore the 60-Day review period expires on May 6, 2022.

3. Background/ Summary. The property is situated on linear shoreline with a meander which creates
an abnormal average lakeshore setback affecting the
subject property and the immediate lakeshore neighbors.

The owners have proposed new additions on the lake
side of the home which will encroach approximately 15
feet into the average lakeshore setback; these additions
include a 14’ x 14.5’ kitchen addition and a 16’ x 16’
three season porch addition. They also propose to
rebuild an existing deck with a slightly expanded
footprint (squaring off currently clipped corners). The
deck will encroach 21.5 feet into the average lakeshore
setback, no closer to the lake than the existing deck. The
three season porch partially encroaches up to
approximately 9 feet.

4. Planning Commission Vote and Comment. On
March 21st, the Planning Commission held a public
hearing. Following the public hearing the Planning
Commission voted 4 to 0 on a motion in favor of
approval for the requested average lakeshore setback variance as presented.

5. Public Comment. Comments from the neighbors were received and are attached as Exhibit D.

6. Staff Recommendation. Staff recommends approval.

COUNCIL ACTION REQUESTED
Move to adopt resolution 7259 at Exhibit A.

Exhibits
A. Proposed Resolution
B. Proposed Plans
C.
