1 <br />221274v1 <br /> <br />DOCK SITE LICENSE AGREEMENT <br /> <br /> <br /> THIS LICENSE AGREEMENT is made on April 11, 2022 between the CITY OF <br />ORONO, a Minnesota municipal corporation, located at 2750 Kelley Parkway, Orono, MN 55323 <br />(the “City”), and Joe Thull, an individual who owns property at 6872 Highover Drive, Chanhassen, <br />MN 55317 (“Licensee”). <br /> <br /> WHEREAS, the City has made available dock sites at specified locations on public <br />property and public rights of way; <br /> <br /> WHEREAS, Licensee wishes to construct and maintain a dock at a dock site and agrees <br />to the terms of this License Agreement; <br /> <br />NOW, THEREFORE, the parties agree as follows: <br /> <br /> 1. License to Use Property. Subject to the terms and conditions of this License <br />Agreement, the City hereby grants to the Licensee a license to use Dock Site # BI-6 (“Dock Site”), <br />as designated on the official Orono Dock Location Map, located in the right of way extended <br />between 440 and 450 Big Island. <br /> <br /> 2. Term. The term of this License Agreement will commence on April 11, 2022 and <br />expire November 1, 2022, unless terminated prior thereto as provided herein. If Licensee complies <br />with all terms and conditions contained in this License Agreement and submits a valid license <br />request for the next season that is received no later than April 15, 2023, the Licensee shall have <br />priority for use of the dock for the next season. <br /> <br /> 3. Conditions. The City and the Licensee agree that the Licensee will use the Dock <br />Site subject to the following conditions: <br /> <br />A. Docks. The Licensee household may obtain only one license. <br /> <br />B. License plates. Dock license plates shall be issued by the city after approval of <br />the license application. The license plate must be securely fixed to the lakeside <br />end of the licensed dock. License plates shall be maintained by the Licensee and <br />shall remain the property of the City. <br /> <br />C. Removal of docks. Upon termination of a dock license, the Licensee must <br />completely vacate the dock and adjacent public right of way. Any accessory item <br />that has not been removed will be removed by the City and all costs the <br />responsibility of the last license holder for that Dock Site. <br /> <br />D. Dock Specifications. Docks within right-of-way on Big Island will not extend <br />more than 24 feet from the Ordinary High Water Line (OHW). <br /> <br /> E. Fires. No fires of any kind shall be permitted on the Dock Site. <br /> <br />F. Landscaping. Licensee shall not cut or disrupt any trees or other vegetation along <br />the shoreline in any way. All landscaping activity must be approved by the City.
