To approve the dock license agreement with Joe Thull for Dock site BI-6 (Massasoit <br />Avenue), as drafted by the City Attorney. <br /> <br />2. Background. On March 14th, the City Council directed the city attorney to draft a license allowing <br />Joe Thull to dock his boat on a city dock to be installed within the extended right of way of Massasoit <br />Avenue. Massasoit Avenue is commonly described as the 30 foot wide right of way south of 450 Big <br />Island, and north of 440 Big Island, on the west side of the peninsula. <br /> <br />3. License. The City Attorney’s office drafted a license agreement based on the standards of the city <br />code, Section 38-903 (b) and council direction, including the priority for acquisition of a license for the <br />2023 boating season. The license is attached as exhibit A. Joe Thull owns 480 Big Island, a land locked <br />parcel north of the requested site. Mr. Thull is eligible to apply for a license. Mr. Thull has indicated that <br />the boat to be stored is 2012 Bennington 20 SL, which will fit in the boat storage area identified on <br />Exhibit C. State Registration has been applied for, but not yet received. <br /> <br />4. Fee. The license fee of $6,000 is applied to this license. <br /> <br />5. Staff Recommendation. Staff recommends approval of the license agreement as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should approve the license as drafted. <br /> <br />Exhibits <br />A.
