Page | 1 April 4, 2022 <br /> <br /> <br />Oare/Abbott <br />Application for Variances and/or Conditional Use Permit <br />Contains the following “Pro” & “Con” aspects: <br /> <br />Cons <br />1.) The (to be) family/guest house does not meet the criteria of (1) acre lot size which is required <br />for guest houses to be built. The homes at 2965 & 2967 were originally ONE property. This <br />original property totaled the acre required to have a guest house prior to being split & sold off <br />to create what is now 2965. <br /> <br />Pros <br />1.) Causes 3 lots with 3 property ID numbers to become 2 legal lots with 2 property ID numbers. <br />Combining 2967 & 2965, which are both non-conforming, creates 1 conforming lot. <br />2.) Inconsistent average lakeshore setback condition is eliminated. <br />3.) Eliminates the full-time use single family home on a virtual “flag” lot with legal lake access width <br />of only 20’ of lakeshore with LMCD-permitted dock rights. <br />4.) Permanently eliminates the LMCD-permitted dock rights, existing structured deck, and stair to <br />the lakeshore. <br />5.) Eliminates the former Swenson (2965) property’s hardcover non-conformity over 25% by 6.84% <br />of the lot size. <br />6.) The present drive easement at 2965 & 2941 will be eliminated. <br />7.) Eliminates substantial existing hardcover. <br />a. The Oares are effectively reducing their new parcel from 29.06% to 25.66% hardcover <br />through the proposed Swenson (2965) lot elimination. <br />8.) The Oares (2967) withdraw their request for adding 2 parking spaces and the respective <br />additional hardcover, which was to be immediately off Casco Point Road. <br />9.) Allows continued use of non-conforming existing conditions that were permitted and granted by <br />municipal processes in the distant & recent past. This continuation supports preserving the <br />rights and privileges once allowed without the needless discarding of past labor & natural <br />materials used in building the existing human habitation that exists today. <br />
