<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7221 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-330 <br /> <br />FILE NO. LA21-000051 <br /> <br /> WHEREAS, on July 21, 2021, Robert Linden Construction (the “Applicant”), applied <br />for variances from the City Code for the property addressed 1074 Loma Linda Avenue and legally <br />described as: <br /> <br />Lot 7, Loma Linda, Hennepin County, Minnesota (hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicant made application to the City of Orono for variances to <br />Orono Municipal Zoning Code Section 78-330 to allow a 16 foot rear setback and a 1.2 foot side <br />setback, where 30 feet and 7.5 feet are required, in conjunction with construction of an addition <br />connecting the detached garage to the home; and construction of a second story over the garage; <br />and <br /> <br /> WHEREAS, on September 20, 2021, after published and mailed notice in <br />accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br />hearing, at which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br /> <br /> WHEREAS, on September 20, 2021, the Planning Commission recommended <br />approval of the variances; and <br /> <br /> WHEREAS, on October 11, 2021, the City Council reviewed the application and <br />the recommendations of the Planning Commission and City staff and tabled the application citing <br />concerns with the substandard side yard setback; and <br /> <br /> WHEREAS, on April 29, 2022, the Applicant provided revised plans for Council <br />review reflecting a 3.5 foot side setback where a 1.2 foot setback exists and continued to request <br />a 16 foot rear setback for additions to the home; and <br /> <br /> WHEREAS, on May 9, 2022, the City Council reviewed the revised plans and <br />voted 4 to 0 to direct staff to draft an approval resolution; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the revised setback variances as described above based on one or more of the <br />following findings of fact concerning the Property:
