applicant's annual multiple or commercial dock license under Section 2.03, and b)all amenities <br /> required for the facility are provided during that year. <br /> Subd. 9. Non-conforming Mooring Areas or Structures. Except as otherwise provided in <br /> this subdivision,this section shall not apply to mooring areas or structures which are licensed or <br /> lawfully in existence on March 31, 1982.No change in the configuration of the mooring area or <br /> structure which results in an increase in slip size or Boat Storage Units may be made without <br /> first securing a license under this section. For purposes of this subdivision the addition of <br /> unrestricted watercraft which are not counted for purposes of determining compliance with <br /> density limitations pursuant to subdivisions 10 and 11, are not considered to be an increase in <br /> Boat Storage Units. When acting on such a license application, the Board shall not limit its <br /> consideration to changes or additions to the facility, but shall consider the entire facility of the <br /> applicant. <br /> Subd. 10. Special Rule for Unrestricted Watercraft at Non-Commercial Docks. <br /> Unrestricted watercraft, as defined in Section 1.02, shall not be counted for purposes of <br /> determining compliance with density limitations of this section at non-commercial docks <br /> provided such unrestricted watercraft are not stored on the water of the Lake or on a mechanical <br /> lift. <br /> Subd. 11. Special Rule for Unrestricted Watercraft at Commercial Docks. Unrestricted <br /> watercraft, as defined in Section 1.02, shall not be counted for purposes of determining <br /> compliance with density limitations of this section at commercial docks provided: <br /> a) the watercraft are not stored in the water of the Lake or on a mechanical lift,and <br /> b) the Board finds that either: <br /> 1) the watercraft are used for public rental,are under the exclusive control of <br /> the rental organization, and do not number more than one such uncounted watercraft for <br /> each 25 feet of shoreline at the site(unless a greater number is required by the Board as a <br /> public amenity); or <br /> 2) the watercraft are used for educational purposes, are under the exclusive <br /> control of the educational organization,and do not number more than one such uncounted <br /> watercraft for each 15 feet of shoreline at the site (unless a greater number is required by <br /> the Board as a public amenity). <br /> 6 <br />
