Matt&Susanne Johnson <br /> 1432 Shoreline Dr <br /> Wayzata MN 55391 <br /> Lake Minnetonka Conservation District <br /> Board of Directors <br /> 5341 Maywood Road,Suite 200 <br /> Mound, MN 55364 <br /> Orono City Hall <br /> City Council <br /> 2750 Kelley Parkway <br /> Orono, MN 55356 <br /> 8.21.15 <br /> LMCD Board of Directors and Orono City Council, <br /> We live at 1432 Shoreline Drive adjacent to the two residential properties owned and operated by Your <br /> Boat Club/EOF Investments located at 1440 & 1442 Shoreline Dr. We are writing this letter to formally <br /> notify the LMCD and Orono City Council of the continued misuse of the subject property and are <br /> requesting your help in enforcing the regulations both agencies have put into place. <br /> The LMCD decision to approve a dock variance at the property was recently overturned by the Court of <br /> Appeals. As residents of Tanager Bay,we have witnesses the continued increased intensity ofehicle, <br /> boat and pedestrian traffic in the last couple years. Any plan to increase or even maintain the current <br /> level of activity at the site is not in the community's best interest. It is our opinion that both agencies - <br /> the LMCD and Orono City Council-play an important role in ensuring public safety and enforcing the <br /> regulations that have been put into place. <br /> The LMCD should be made aware that the site is currently being used to launch boats over the shoreline- <br /> on more than one occasion (See Exhibit A), slip renters are spilling gas into the lake (See Exhibit B) and <br /> PWC (owned by the landowner) are being used after the legal time (See Exhibit C). <br /> The Orono City Council should be made aware that the residentially zoned property with a CUP for <br /> "overflow parking only" continues to be misused. Examples include: parking lot has been increased by <br /> parking on the grass within feet of the Lake (See Exhibit D),use of the residential property for <br /> commercial use/storage (See Exhibit E),parking of trailers and boats on the shoulder/residential lot (See <br /> Exhibit F), expanded YBC staff use of Tanager Bay slips (Exhibit G),public urination (Exhibit H), and <br /> nighttime use of the Gazebo (Exhibit I). <br /> In reviewing the Exhibits it is exceptionally clear that there is an intentional,prolonged disregard for the <br /> conditions that have been applied to the property.
