CITY OF ORONO
Street Address: Mailing Address: Telephone(952)249-4600
<•< 2750 Kelley Parkway P.O. Box 66 Fax (952)249-4616
9kFSHOC Orono,MN 55356 Crystal Bay,MN 55323 www.ci.orono.mn.us
October 1, 2015
Michael Jellish VIA EMAIL
Your Boat Club michael@yourboatclub.com
1444 Shoreline Drive
Re: City Code Violations at 1442 and 1440 Shoreline Drive
Dear Mr.Jellish,
The City of Orono has received a complaint regarding the condition of your property located at 1442 and 1440 Shoreline
Drive. In response, we visited on site on September 9. Before and during my site visit, I observed the following issues: 1.
Parking on the grass area at 1442 and 1440 Shoreline Drive, 2. Storage of commercial related items (snow fence, dock
bumpers, tarps, and pontoon cushions) at 1440 Shoreline Dr., and 3. Missing boards in the attached wood deck at 1440
Shoreline Drive.
The two parcels referenced above are zoned residential and are improved with single family homes. Both homes appear to
be vacant. The yard area between the homes and the street is improved with gravel, and is used for overflow parking for the
adjacent"Your Boat Club" business. This improvement was approved by agreement in 1983 and confirmed by CUP in 1989.
Parking. As you suggested, the ordinance does not prohibit parking on grass in a residential zone. However parking in general
is an accessory use. Commercial parking is relegated to the areas outlined in the approved site plan from 1989, originally
authorized in 1983. All parking within the grass area must be accessory to the residential use of the property. I understand
that the SUV I observed is the property owner's vehicle.
Storage of items. The Conditional Use Permit does not provide for the use of the residential property for commercial purposes
other than overflow parking. Please remove all commercial-use related items from the property (snow fence, tarps, dock
bumbers). I understand that some interior improvements are being contemplated, please recognize that a building permit
may be required. Please contact the Building Official, Roger Peitso with any questions on building permits.
Deck. There is a damaged board on the deck attached to 1440 Shoreline. Please replace this board as it creates a hazard for
deck users.
78-922. Unlawful act. It is unlawful to violate any condition of a Conditional Use Permit. Please refrain from parking
commercial related vehicles in the grass area, or outside of the parking lot identified by the Conditional Use Permit (plan
attached). Please remove commercial items from the house, including dock bumpers, pontoon and boat seats, and snow
fencing. This work must be completed by October 12,2015. If additional time is necessary, that request must be received by
October 12, 2015. I also understand you have made an application to amend your CUP, perhaps it would be advantageous
to meet to discuss a comprehensive solution to these issues. Please call me with any questions at 952-249-4626.
Sincerely,
CITY OF ORONO
Jeremy B hart,AICP
Community Development Director
Enclosures
