Lowell and Lois Arneson for $184, 900. <br /> This represents an increase in value of approximately 5 percent in <br /> a period of just eight months . See Exhibit H. <br /> 7. That the same property was sold by the Arnesons to <br /> Robert Letendre, Sr. and Theresa L. Wiebe for $130, 000 in April of <br /> 1986. This significant drop in value represents a decrease of <br /> approximately 30 percent after two and a half years of ownership <br /> by the Arnesons . See Exhibit I . <br /> 8. That Mr . Letendre and Ms. Wiebe both admit in their <br /> respective affidavits, that they had knowledge that the validity <br /> and legality of the dock was in question prior to the purchase of <br /> their home on the interior lot of the Chapman Addition and that <br /> they had been informed that the dock may be in violation of City <br /> Ordinances. <br /> 9. That the questions regarding riparian rights on the <br /> property in question were received by city staff prior to the sale <br /> by Arneson to Letendre/Wiebe and that the staff consistently <br /> informed the callers that the interior lot had no riparian rights <br /> and that such rights would be in violation of City ordinances and <br /> pertinent resolutions. <br /> 10. That Letendre and Wiebe had actual knowledge, or should <br /> have had constructive knowledge that the easement was in fact <br /> invalid and therefore were able to purchase the house on the <br /> interior lot for a substantially reduced price . <br /> -2- <br />
