Wiebe, <br /> AFFIDAVIT OF MARK E. <br /> in Relation to Certificate of BERNHARDSON <br /> Title No. 681809 issued for/and <br /> in the County of Hennepin and <br /> State of Minnesota and legally <br /> described as follows : <br /> Lot 1, Block 2, Chapman Addition <br /> Mark E. Bernhardson, having been first duly sworn on oath <br /> states and deposes as follows : <br /> 1. That I am the City Administrator for the City of Orono <br /> ( "City" ) and have been since May 1, 1985. <br /> 2. That in my capacity as the City Administrator I have <br /> dealt with this matter under the direction of the City Council. <br /> 3. That prior to granting a subdivision request of <br /> lakeshore property, the City Council has consistently conditioned <br /> approval upon the applicant ' s agreement that only lakeshore <br /> property with adequate lakeshore frontage would remain riparian <br /> with all the rights therein. <br /> 4. That such a condition was included in the Resolution <br /> approving the Chapman Addition plat which granted Chapman the <br /> right to subdivide his property and thereby create the lakeshore <br /> lot and the interior lot, which is now in question. <br /> 5. That the assessment records of the City show that the <br /> interior lot, now in question, was sold by Chapman to Douglas and <br />
