At the conclusion of the review, the Planning Commission gave <br /> conceptual approval to the proposed plat creating a lakeshore and <br /> interior lot with the condition that only the lakeshore lot would <br /> have riparian rights . See Exhibit A. <br /> August 13 , 1979 , Mr . Chapman appeared again before the <br /> Planning Commission with a revised plan, horizontally dividing his <br /> property into two lots . Upon Mr . Chapman ' s agreement that only the <br /> lakeshore lot would have riparian rights , the Planning Commission <br /> forwarded its recommendation for approval to the City Council . See <br /> Exhibit B . <br /> On August 28th, 1979 , the City Council reviewed the Chapman ' s <br /> Land Use Application and voted to approve the subdivision with the <br /> condition, inter alia , that only the lakeshore lot was to have <br /> riparian rights . See Exhibit C. <br /> Mr . Allen Olson, then City Planner , sent a memorandum to Mr . <br /> Chapman on the following day, indicating the City Council ' s <br /> preliminary approval and setting forth the conditions to be met . <br /> Included in the list of conditions were the conditions that only <br /> the lakeshore lot could be riparian and that the interior lot was <br /> to be non-riparian with no lake access or dock rights . See <br /> Exhibit D. The interior lot is the lot currently owned by the <br /> Petitioners . <br /> Finally, on January 15 , 1980 , Resolution No . 1102 was passed <br /> by the City Council approving the Chapman Addition Plat creating <br /> Lot 1 and 2 , Block 1, Chapman Addition. The resolution set forth <br /> the condition that only the lakeshore lot was to have riparian <br /> rights . See Exhibit E. <br /> -2- <br />
