Wiebe, <br /> MEMORANDUM OF CITY OF ORONO <br /> in Relation to Certificate of IN OPPOSITION TO <br /> Title No . 681809 issued for/and MOTION FOR SUMMARY JUDGMENT <br /> in the County of Hennepin and <br /> State of Minnesota and legally <br /> described as follows : <br /> Lot 1, Block 2 , Chapman Addition <br /> INTRODUCTION <br /> The issue in this case arises out of the City of Orono ' s <br /> (City) objection to Letendre and Wiebe ' s (Petitioners) attempt to <br /> add an invalid easement to the legal description of their <br /> property. <br /> In 1978 , Mr . Kenneth Chapman submitted an application to the <br /> City to subdivide his lakeshore property into two lots . On October <br /> 10, 1978, the application was first reviewed by the Planning <br /> Commission. The original subdivision plan brought forth by Mr . <br /> Chapman divided his property vertically, creating two side-by-side <br /> lots , each with approximately 117 feet of lakeshore . The proposed <br /> side-by-side lots did not meet the City' s zoning code regulations <br /> which required 140 foot width per lot . Therefore, the Planning <br /> Commission suggested to Mr . Chapman that he change the <br /> configuration of the subdivision so as to divide the property <br /> horizontally and thereby create one lakeshore lot and one interior <br /> lot . <br />
