AGENDA ITEM <br />Prepared By: LLO Reviewed By: J. Barnhart Approved By: <br />1.Purpose. The applicant is requesting approval of a conditional use permit for a permanent dock. <br />2.Background. The applicant wishes to install a permanent dock. Because of the permanent nature of <br />the dock structure within the floodway, a conditional use permit (CUP) is required. The Lake <br />Minnetonka Conservation District (LMCD) regulates docks on the Lake. <br />The applicant is coordinating with the LMCD regarding size and placement of the permanent dock. An <br />updated site plan is attached. <br />3.15.99 Deadline. The application was received on November 3, 2021 and was considered to be complete <br />on December 3, 2021. The 60-Day review period has been extended and now expires on April 2, 2022. <br />4.Planning Commission Vote and Comment On January 18th, 2022, the Planning Commission held a <br />public hearing. The Planning Commission discussed the limited impact the project will have on the <br />floodplain and noted the submitted written comments with concerns with dock placement fall under LMCD <br />review and permitting. One public comment was received during the meeting, see attached minutes. <br />Following the public hearing the Planning Commission voted 4 to 0 on a motion to approve the requested <br />conditional use permit. <br />5.Public Comment. One written comment was received and one resident spoke at the public hearing. <br />See attached meeting minutes and public comment. <br />6.Staff Recommendation.
