A RESOLUTION ORDERING ABATEMENT OF HAZARDOUS <br /> BUILDING ACTION AT 300 TONKA AVENUE AS LEGALLY <br /> DESCRIBED HEREIN <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the state of Minnesota; and <br /> WHEREAS, James L. Patrin, 73 West George Street, Saint Paul, <br /> Minnesota is the fee owner of record of property located at 300 Tonka <br /> Avenue, Orono, hereinafter referred to as "the Patrin property" , legally <br /> described as : <br /> Lots 17 & 18, Block 5, Bayside Addition to Lake Minnetonka <br /> WHEREAS, the City Council of the City of Orono, having duly <br /> considered the matter pursuant to Minnesota Statutes Sections 463. 15 <br /> to 463. 261, hereby finds that the above described Patrin property is <br /> unhabitable and contains unsanitary and hazardous conditions which <br /> constitute a public nuisance and which makes this property hazardous <br /> to the public health and safety as follows: <br /> 1) The Patrin property is located in the rural service <br /> area of the City where there is no municipal sanitary <br /> sewer or water available. <br /> 2) The Patrin property contains one unhabitable building <br /> and a small shed/outhouse on approximately 12, 500 <br /> square feet of land, which is approximately 1/8 of <br /> the minimum 2 acres required by City ordinances in <br /> order to provide adequate area for on-site treatment <br /> of sewage generated on each property. <br /> 3) No sanitation facilities in structure - outhouse in <br /> back of lot. <br /> 4) There is no running water in structure and there is <br /> no well located on the property. <br /> 5) The structure was damaged by fire on July 3, 1979. <br /> Roof was destroyed by the fire and never repaired. <br /> 6) Structure is in state of deterioration and dilapitation. <br /> 7) Orders to remove structure were issued by the Building <br /> Official on June 14, 1982 . This order has not been <br /> complied with. <br /> NOW, THEREFORE BE IT RESOLVED as follows : <br /> Page 1 of 2 <br />
