AGREEMENT AND CONTRACT FOR <br />BIIILDING INSPECTION SBRVICES <br />i <br />of ,, : <br />This agreement is made and entered into this day <br />i;' r,F< 19 'L, by and between the City of Orono, Minnesota and <br />the City of` Minnetonka Beach is made under and by virtue of Minnesota <br />Statues ' 1971, Chapter 561, Section 16.861. <br />Witnesseth: <br />WHEREAS, City of Minnetonka Beach is desirous of contracting with <br />the City of Orono for the performance of the hereinafter specified building <br />inspection services within the City of Minnetonka Beach; and <br />WHEREAS, the City of Orono is agreeable to render such services <br />on the terms and conditions hereinafter set forth; and <br />WHEREAS, an agreement such as this is authorized under and by <br />virtue of the provisions of Minnesota Statutes Section 16.861, Subdivisions <br />1 and 2. <br />NOW, THER$FORE, he City of Orono agrees that it wi 11 provide <br />building inspection services for the City of Minnetonka Beach subject to <br />the following terms and conditions: <br />1.Definition of Building__Code. The "Building Code" <br />administered and enforced under the terms of this agreement shall mean <br />the current edition of the Minnesota State Building Code as adopted by <br />Minnesota Statutes Sections 16.83 to 16.867 including the following <br />rules and codes adopted by reference therein; and including revised or <br />updated editions of said rules and codes as may from time to time be <br />duly adopted by the State: <br />A) 1985 Edition of the State Build.ing Code ("SBC") rules <br />identified as 2 MCAR 1.0101 throught 2 MCAR 1.18901, including <br />SBC Appendix "A", Technical Requirements for Fallout Shelters, <br />and SBC Appendix "B", variations in Snow Loads; <br />B) 1985 Edition of the Uniform Building Code, ("UBC") as adopted <br />by the State of Minnesota, including Appendix Chapters 32, <br />reroofing; 35, Sound Transmission Control; 49, Patio Covers; 55, <br />Membrane Structures; and 70, Excavation and Grading; <br />C) 1981 Edition of the National Electric code, identified as <br />nNEC° <br />D) 1978 American National Standard Safety Code for Elevators, <br />Dumbwaiters, Escalators and Moving Walks, identified as ANSI <br />A17.1-1978 and Supplement ANSI a17.1a-1979; <br />E) 1979 Minnesota Plumbing Code, identified as Chapter 4715 <br />extracted from Minnesota Rules 1983 including amendments adopted <br />January 7, 1985; <br />Page 1 of 7
