<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-330 and 78-1279 <br /> <br />FILE NO. LA21-000012 <br /> <br /> WHEREAS, on February 2, 2021, Clairmon Design Build (“Applicant”), applied for <br />variances from the City Code for the property addressed 1260 Spruce Place and legally described <br />as: <br /> <br />Lot , Block 10, Saga Hill Revised, Hennepin County, Minnesota, together with that <br />part of vacated Lake Street adjoining said Lot 1, Block 10, as shown on the survey attached <br />to Notice of Vacation on Book 848 of Miscellaneous, Page 596, Document No. 3213583 filed <br />in the office of the Register of Deeds, Hennepin County, Minnesota (hereinafter the <br />“Property”); <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-330 to allow a 2nd floor addition within the <br />side yard setback; and <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1279 to allow a 2nd floor addition within the <br />average lakeshore setback and within the 75 foot lakeyard setback; and <br /> <br /> WHEREAS, on February 16, 2021, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br /> <br /> WHEREAS, on February 16, 2021 the Planning Commission recommended <br />approval of the variance; and <br /> <br /> WHEREAS, on March 8, 2021, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br /> <br /> WHEREAS, on March 8, 2021, the City Council directed preparation of findings for <br />approval of the variance. <br />
