This application is regarding two conditional use permits (CUP): one for a guest house <br />and one for plumbing with a shower in the pool cabana. <br /> <br />2. MN§15.99 Application Deadline. The application was received and considered to be complete <br />on September 22, 2020. Therefore the 60-Day review period expires on November 21, 2020. <br /> <br />3. Background/ Summary. The applicant is proposing to construct a new carriage house with a <br />guest house use on the upper floor; and a pool cabana with a full bathroom. Both uses require <br />conditional use permits. The property is 7.9 acres in area where 2.0 acres is the minimum <br />required. A guest house requires at least 4.0 acres in the RR-1B district. Both buildings will be <br />conforming with respect to size and location. <br /> <br />4. Planning Commission Vote and Comment. On October 19th, the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 6 to 0 in favor of a <br />motion to approve the requested CUPs contingent upon the property owner signing the <br />appropriate covenants. <br /> <br />5. Public Comment. No comments from the public were received. <br /> <br />6. Staff Recommendation. Staff recommends approval of both CUPs conditioned upon the <br />property owner’s agreement to the filing of the standard covenants in the title of the property. The <br />covenants specify that neither building will not be used for a home occupation, rented, or leased <br />under any circumstances. The pool cabana will not be used as a dwelling unless a guest house <br />conditional use permit is obtained. <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the approval resolution. <br /> <br />Exhibits <br />A.
