Consider directing Staff to review a text amendment related to residential dock use <br />and certain exceptions. <br /> <br />2. Background. The Mayor has requested this item be placed on the agenda. <br /> <br />In the course of enforcing the dock regulations that prohibit rental of docks, staff has learned that <br />the non-resident users of the dock live in the neighborhood a short distance away. These <br />residents contacted the Mayor about options. <br /> <br />The Mayor recalled an exemption considered by the city in the past; this exception would allow a <br />non-lakeshore property owner to dock their boat in an agreeing lakeshore property owner’s dock, <br />provided that this dock was within 1,000 feet of their property. That exemption, and others, were <br />considered by the Planning Commission on May 21, 2012. The Planning Commission did not <br />support the “proximity” exception. <br /> <br />The Council reviewed the proposed ordinance at their meeting on June 11, 2012, and after much <br />discussion, directed staff to prepare an ordinance for adoption which included no exceptions. The <br />final ordinance was approved on June 25, 2012, on consent. The applicable text has not been <br />amended since then. The packet for the June 11, 2012 City Council meeting is attached as <br />Exhibit A and includes the planning commission packet from May 2012 and discussion. The <br />minutes from that meeting are attached as Exhibit B. <br /> <br />If authorized to proceed, staff envisions discussion at a future Council workshop to fully <br />understand Council’s goals, prior to initiating formal public hearing process. <br /> <br />3. Staff Recommendation. Staff seeks direction. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should provide direction whether or not to proceed. <br /> <br />Exhibits <br />A.
