Variances. <br /> Variances to hardcover, if granted on lots within the Stormwater Quality Overlay <br /> District,may be subject to mitigation measures deemed appropriate by the City Council <br /> to offset the impacts generated by the proposed additional hardcover. <br /> Sec. 78-1687—78-1699. Reserved. <br /> DIVISION 3. REGULATIONS BASED ON ASSIGNED PROTECTION TIER AND <br /> UNDERLYING ZONING <br /> Sec. 78-1700. Specific Tier Regulations. <br /> Per the official Stormwater Quality Overlay District Map, each property in the <br /> stormwater quality protection overlay district is assigned to a protection tier based on its <br /> relative distance to receiving waters. This protection tier dictates the specific protection <br /> measures that must be implemented. <br /> (1) Tier 1 Parcels <br /> Hardcover shall not exceed twenty-five (25) percent of the gross lot area, <br /> (2) Tier 2 Parcels <br /> Hardcover shall not exceed thirty(30)percent of the gross lot area. <br /> (3) Tier 3 Parcels <br /> Hardcover shall not exceed thirty-five (35) percent of the gross lot area. <br /> (4) Tier 4 Parcels <br /> Hardcover shall not exceed fifty(50)percent of the gross lot area, <br /> (5) Tier 5 Parcels <br /> Hardcover shall not exceed eighty-five (85)percent of the gross lot area. <br /> Sec. 78-1701. Tier Assignment Methodology <br /> The inclusion of parcels into the Stormwater Quality Overlay District is based on the <br /> following methodology. <br /> (1) Examine each parcel and determine whether or not it abuts a protected lakeshore <br /> or stream. <br /> a.
