5.2.2.4 Credit Criteria <br /> For Commercial Properties,where the no-Credit conditions do not apply,prior wastewater demand is <br /> calculated by: i)if SAC was paid it is the number of SAC units paid reduced by any Credits that were <br /> used off the Site by the Community(i.e.the gross SAC units charged is the SAC Credit); or ii)if <br /> SAC was not paid a Non-Conforming Credit is available upon Community application if and when <br /> records are provided for a Site which indicates either a)a Grandparent Demand that has been in <br /> existence when SAC started(1973,with evidence from 1968-1978)or a prior acceptance of <br /> Grandparent Demand for the Site; or b)if not Grandparent Demand, a Long Continuous Demand <br /> from the Site for 10 or more years prior to the current Determination or permit issuance and within 0- <br /> 3 years of the current Determination.The allowance of a Long Continuous Demand Credit(where <br /> SAC was mistakenly not paid)must be for the benefit of a different owner then who should have <br /> paid SAC originally. The Community needs to provide documentation for either of these Non- <br /> Conforming Demands to establish Credit. It is acknowledged that this may be hard for a Community <br /> and thus the applicability of such Non-Conforming Credits are rare. <br /> For Non-Conforming Grandparent Demand,if documentation is not provided,and MCES has no <br /> SAC history but there is information from the County website that show the property was built prior <br /> to 1973,the Credit will be determined based on a minimal use(warehouse,office,and/or retail). If <br /> detailed plans are not available, 80%of gross square footage is used to calculate Credit(this is the <br /> assumed usable space)of a minimum use type(e.g.retail, office,warehouse). If the gross square <br /> footage is not provided, one Credit per building will be assigned. Communities may not assign a <br /> minimum charge for each individual business occupying a building. Alternatively to providing full <br /> historical details, MCES may accept a certification of a Community official about the prior use of a <br /> Site(with form Affidavit-C). <br /> If Non-Conforming Grandparent Demand Credits are applied for a Site,that redetermination is the <br /> basis for future redeterminations,not the Grandparent Demand from 1973 (that is, 1973 <br /> P <br /> grandparenting data is no longer relevant).However,Net Credits from Grandparent Demand are <br /> reserved for a company's growth on that Site for 5 additional years after the redetermination and <br /> permit issuance. <br /> For Non-Conforming Long Continuous Demand,the Community will need to provide evidence of <br /> the Continuous Demand for 10 or more years prior to the current Determination or permit issuance <br /> and within 3 years of the current Determination. Evidence can include: i)a dated building plan <br /> associated with a building or sewer permit; ii)business license for consecutive years detailing the <br /> specific use and size of the space; or iii)other dated documentation that details the specific use and <br /> size. Alternatively to providing full Continuous Demand details,MCES may accept a certification of <br /> a Community official about the prior use of a Site(with form Affidavit-C). <br /> No Net Credits are generated by the unused potential Credits from Non-Conforming Long <br /> Continuous Demand. <br /> All Credit Determinations are subject to review and approval of MCES. Contact MCES for any <br /> questions or estimates. <br /> 5.2.2.4.1 Credit Criteria for Restaurants <br /> SAC calculations for restaurants will be calculated on the incremental seat count if the previous use <br /> was also a restaurant. (e.g.Burger King remodeling to a Perkins.)The Determination will charge the <br /> new seats only(i.e.the new submitted plan seats less the number of seats that were determined and <br /> reported to MCES previously).These incremental seats will be charged at the current rate and criteria <br /> with the new Determination.
