5.2.1.5 Determinations <br /> A Determination is required whenever there is a change or increase in use or an official <br /> acknowledged change in sewer demand(e.g. issuance of a business permit for which SAC has not <br /> been paid),whether or not a Demolition is involved. Examples that require a Determination include: <br /> a change from retail to restaurant,tenant build-out of a speculative office/warehouse space,most <br /> physical changes in the building that requires a building and/or plumbing permit(unless it fits <br /> exclusion criteria in 5.2.1.5.4), and any tenant changes that differ from the previous use of the space <br /> (as defined for SAC purposes). <br /> Temporary New Uses are assigned SAC units in the same manner as permanent New Uses,unless <br /> they qualify for a Temporary Capacity Charge(see Section 5.2.1.11). <br /> When the use of the space is calculated using fixture unit criteria, fixture rough-ins count toward the <br /> total SAC Determination calculation. In types of building use that do not use fixture units to calculate <br /> the SAC(e.g. office building or salon)a rough-in for a shower will be added towards the total SAC <br /> Determination. <br /> When a new tenant moves into a retail shopping center and the use is changed, an updated tenant <br /> listing should be supplied to MCES as part of the Determination process. The listing should include a <br /> current list of all tenants and suite numbers. <br /> 5.2.1.5.1 Determination Submittal <br /> Those that request MCES to complete a Determination will require submission of the MCES <br /> Transmittal-A(SAC Determination Application) form and any other form applicable that can be <br /> found in Appendix B along with scalable floor plans. The floor plans submitted to MCES must be the <br /> same ones submitted to the Community for their review. Scalable,electronic (e.g.PDF) floor plans <br /> are preferred.The floor plans must include a specified use of each room/space. Electronic <br /> Determination submittal is preferred,via email,to: SACprogramAmetc.state.mn.us. <br /> 5.2.1.5.2 Determination Forms <br /> See Appendix B for a copy of the example Determination forms. <br /> 5.2.1.5.2.1 MCES Transmittal-A—SAC Determination Application <br /> This is a required form,which includes the submittal checklist,to be sent for all Determination <br /> requests for Metropolitan Council.Incomplete forms and submittals will not be accepted. <br /> 5.2.1.5.2.1 MCES Transmittal-B—Additional Submittal Requirements <br /> This form is a list of additional submittal questions and information needed in order to complete the <br /> SAC Determination for certain business uses.This form must be filled out and signed by the business <br /> owner and submitted with the other items listed on the SAC Determination Application. <br /> 5.2.1.5.2.1 MCES Transmittal-C—Temporary Capacity Charge <br /> This form is required if the Community is requesting a Temporary Capacity Charge in lieu of regular <br /> SAC payment for a business. See Section 5.2.1.11 for further details on this type of charge. <br /> 5.2.1.5.2.1 MCES Affidavit-A—Affidavit of Business Use— Food and Drink Establishments <br /> This form is required to be submitted with the other items listed on the SAC Determination <br /> Application if the business use is a food/drink establishment.
