This application is regarding hardcover, side setback, and average lakeshore setback <br />variances to construct a 2nd story and new deck. <br />2.MN§15.99 Application Deadline. The application was received and considered to be complete on <br />June 23rd. Due to meeting timing, the application was extended. Therefore, the extended 60-Day review <br />period expires on October 21, 2021. <br />3.Background/ Summary. The applicant is <br />requesting hardcover, side setback, and average <br />lakeshore setback variances in order to construct a 2nd <br />story addition above the existing footprint and new <br />lakeside deck on the existing home. The existing home <br />is situated 2.6 feet from the north side lot line and <br />entirely lakeward of the average lakeshore setback line. <br />The hardcover currently exceeds the 25% limitation; <br />the applicant’s revised request results in an estimated <br />113 square foot hardcover reduction. <br />4.Planning Commission Vote and Comment. <br />During the July 19th Planning Commission public <br />hearing the Commission voted 6 to 0 in favor of <br />approving the variances according to the staff <br />recommendation which included moving the deck and <br />deck stair into the property to meet the 7.5-foot side <br />setback. The applicant heard Planning Commission and Staff concerns about creating a new <br />encroachment with the deck and modified the proposed plan. <br />The applicant continues to request approval for the deck to extend into the side setback. They have <br />revised the house plans to reflect the new deck and deck stair staying in line with the footprint of the home <br />resulting in an approximate 2.8 foot side setback for the new deck where a 7.5 foot setback is required. <br />The house plans (Exhibit A) have been modified to reflect this change; however, the survey has not yet <br />been updated. To show the proposed change, Staff edited the survey and the hardcover calculation based <br />on the estimated deck footprint shown on the revised house plan. <br />5.Public Comment. No written comments were received from the neighbors. The neighbors to the <br />south were in attendance and provided supportive comments during the public hearing.
