FILE #LA21-000035 <br />May 17, 2021 <br />Page 2 of 6 <br /> <br />Staff does not support the backlighting of the canopy. <br /> <br />Background <br />**The city is currently reviewing potential changes to the sign ordinance (LA21-000028). Applying <br />the regulations to real world examples, including the original sign permit application for this <br />project, staff recognized that the intended goals are not realized. For example, the regulations <br />for neighborhood identification signs, and incidental signs not clearly defined. The following <br />analysis is based on the existing code. ** <br /> <br />The subject property has been a gas station since at least 1980. A number of variances and <br />conditional use permits have been approved for the property, including resolutions 2073 and <br />4420, which approved variances for signage in 1986 and 2000, respectively. These approvals are <br />summarized in the table attached as Exhibit D. <br /> <br />When a project does not conform to the standards of a previously approved variance, the <br />variance is from the existing city code, not the standards established by the variance. Legal non- <br />conforming structures may be rebuilt in kind, without the need for a variance. <br /> <br /> <br />Proposal. <br />The applicants propose a sign package that includes: <br /> <br />Free standing sign Replacing an existing freestanding sign (Exhibit C-1). The sign is <br />20 feet tall, 95.79 sq ft of sign copy area, the monument sign is <br />141.66 sq ft. The sign area includes 20.16 sq ft of changeable <br />copy (21%). The changeable copy calculation does not include <br />the fuel price. The sign exceeds the number, area, monument <br />sign area, and changeable copy area prescribed by Ordinance. <br />Monument and changeable copy are functions of the sign copy <br />area. <br /> The height proposed, 20 feet, is allowed per section 78-1373, <br />which allows signs for gas stations to be 22 feet tall. <br /> <br />Building sign A new building wall sign 20 sq ft (Exhibit C-2) No variance <br />needed. <br /> <br />Canopy sign (3, each 12.7 sq ft) Also proposed is a LED backlit canopy <br />(Exhibit C-3) Only one edge faces a street, in staffs opinion, <br />therefore 2 canopy signs requires a variance. Illumination of <br />canopy requires a variance. <br /> <br />No changes are proposed for the existing free standing sign located on the west side of the <br />property. <br /> <br />
