The City of Orono and Law Enforcement Labor Service, Inc. (LELS) are parties to <br />a labor agreement. In May a grievance was received from LELS on behalf of an Orono officer. <br />The nature of the grievance was that the officer was denied the 3-hour minimum for attending a <br />department training. LELS indicated that this action violated Article 14 of the collective <br />bargaining agreement. Article 14 states: “An employee who is called to duty during his <br />scheduled off-duty time shall receive a minimum of three (3) hours pay at one and one-half (1- <br />1/2) times the employee’s base pay rate. An extension or early report to a regularly scheduled <br />shift for duty does not qualify the employee for the three (3) hour minimum.” <br /> <br />After meeting with LELS business agent, union stewards and the officer it was determined that <br />this did not violate Article 14, however there needed to be clarification related to Article 26 & <br />Article 14 of the current collective bargaining agreement. <br /> <br />A Memo of Understanding (MOU) between LELS and the City of Orono was drafted to clarify <br />these issues. The MOU has been reviewed by city attorney. <br /> <br />The duration of the MOU will follow the existing contracts of December 31, 2022. <br /> <br />2. Staff Recommendation. I recommend approval of the Memo of Understanding between LELS <br />and City of Orono <br /> <br />COUNCIL ACTION REQUESTED <br /> <br />Motion to approve the Memo of Understanding between Law Enforcement Labor Services, Inc, Local 40 <br />and the City of Orono. <br /> <br /> <br /> <br />Exhibits <br />A.
