The Commission should comment on this <br />space as meeting the private recreation requirement. <br /> <br />Applicable Regulations: <br />Division 10 of the Orono Zoning Code-RPUD regulation (Exhibit K) <br /> <br />Analysis: <br />Building Height. Building Height is limited to 30 feet, though the Council has the discretion to <br />approve a building higher than 30 feet. The Building Height Analysis (Exhibit L) shows the building <br />at 31’-0”. The applicant has proposed to lower the ceilings of each of the floor 1 inch, bringing <br />the building to 30’ 9”, though the plans have not been revised. <br /> <br />RPUD zoning establishes a number of conditions and/or criteria. Staffs analysis of these <br />conditions is summarized in the following table. <br /> <br />Section Standard Conforming? <br />1 (1) Minimum area: 5 acres or certain <br />exceptions… <br /> <br />The property to be platted is 2.48 acres. The <br />Council may find that the project conforms to <br />the exception under C: The property is located <br />in an area where the proposed development <br />provides a transition between a commercial or <br />industrial area and an existing residential area <br />or on an intermediate or principal arterial as <br />defined in the comprehensive plan. <br />2 Uses. Each development in the <br />RPUD district shall have a density <br />within the range specified in the <br />comprehensive plan for the specific <br />site. <br />The Comprehensive Plan guides the property <br />high density residential, 20-25 units per acre. <br />Including the day care center, density comes in <br />at 18.23 units per acre, (48 units over 2.63 <br />acres) which is lower than the 20 units per acre <br />required by the Comprehensive Plan. A <br />Comprehensive Plan amendment will be <br />required. <br />5 Incentives.
