Per the appropriate documents, including the ground lease and Development <br /> Agreements the financial assistance package for the senior housing site to ensure <br /> the property remains in use as a residential property for senior housing for long <br /> period of time have been approved. <br /> 17. Approval shall be subject to the Council's adoption of the RPUD district with <br /> the Final Plat Approval. <br /> 18. The Preliminary Plat approval is not an approval of the rezoning or Preliminary <br /> Plat. The rezoning and Comprehensive Plan Amendment shall not be approved <br /> until the Final Plat approval, subject to the Developer, and City enter into and <br /> execute a Developer's Agreement and ground lease. <br /> 19. The City Engineer has completed an estimate of improvement costs, including <br /> but not limited to landscaping, grading, erosion control, utilities, pavement, trails, <br /> retaining walls and pond/outlet control structure construction and the applicant <br /> shall submit to the City a financial guarantee of subject to a <br /> Developer's Agreement being executed by the developer and City of Orono. <br /> 20. Drainage and Utility Easements shall be dedicated to the public on the final plat <br /> 10' along all exterior property lines and 5' along the interior property line. <br /> 21. Additional Drainage and Utility Easements shall be dedicated to the public on <br /> the final plat over all utility lines and rights of way. <br /> 22. Final road easement to permit public ingress/egress over the service/frontage road <br /> shall be granted to the public. <br /> 23. Authorities granted by this resolution run with the property not with the owners, <br /> but are permissive only as set forth by the special conditions of this resolution <br /> will expire one year from the date of Council approval on that date <br /> ( , 2002). <br /> 24.
