CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 7 2 1 2 <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />RESOLUTION DISPENSING WITH STATUTORY REQUIREMENTS FOR REVIEW BY <br />PLANNING COMMISSION OF SALE OF PROPERTY, APPROVING THE SALE OF REAL <br />PROPERTY, AND APPROVING A LOT LINE ADJUSTMENT <br />WHEREAS, Mr. Brian Huisman and Mrs. Anne Huisman ("Owners") are the owners of real <br />property located at 1121 North Arm Drive, Orono, Minnesota 55364, PID: 0711723140063 and said parcel <br />is currently legally described on the attached Exhibit A ("Current Applicant Property"); and <br />WHEREAS, Mr. Huisman submitted a Land Use Application ("Application") to the City of Orono <br />("City") requesting a boundary line adjustment for the Current Applicant Property; and <br />WHEREAS, the Current Applicant Property abuts parcels of land that is purportedly owned by <br />the City, and said parcels are currently legally described on the attached Exhibit B ("Current City Parcels"); <br />and <br />WHEREAS, a substantial portion of the Current City Parcels are submerged and under the ordinary <br />high water (OHW) line; and <br />WHEREAS, the Application proposes adjusting the common property line in a manner that would <br />enlarge the Current Applicant Property ("Final Applicant Property") and reduce the Current City Parcels <br />("Final City Parcels") as provided in the attached survey attached as Exhibit C; and <br />WHEREAS, the City wishes to convey to Owners via quit claim deed the portion of the Current <br />City Parcels that is being reduced by virtue of the proposed boundary line adjustment in the Application for <br />$1.00, and the property to be conveyed in legally described as Exhibit D; and <br />WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the <br />acquisition and disposal of any publicly owned interest in real property within the City; and <br />WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning <br />Commission review requirement upon 2/3 vote of the governing body dispensing with the requirement and <br />finding that the acquisition and disposal of the property has no relationship to the comprehensive municipal <br />plan; and <br />WHEREAS, the City wishes to approve the Application, which would result in the legal <br />description for the Final Applicant Property as set forth in Exhibit E, and the legal description for the Final <br />City Parcels as set forth in Exhibit F; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono: <br />
