FILE#LA21-000060 <br /> 20 Sept 2021 <br /> • Page 5 of 5 <br /> regarding the use of the property,and the applicant has designed the improvements to <br /> improve the use and mitigate any potential nuisances on the property. <br /> 12) Not cause excessive non-residential traffic on residential streets, parking needs that cause a <br /> demonstrable inconvenience to adjoining properties,traffic congestion, or unsafe access; <br /> This criterion is met. <br /> 13) Designed to take into account the natural,scenic, and historic features of the area and to <br /> minimize environmental impact; This criterion is met. <br /> 14) All exterior lighting shall be so directed so as not to cast glare toward or onto the public <br /> right-of-way or neighboring residential uses or districts; The applicant is advised of this <br /> requirement and has provided a lighting plan;and <br /> 15) Not detrimental to the public health, public safety,or general welfare.This condition is <br /> met. <br /> A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, a CUP <br /> shall remain in effect as long as the conditions imposed by the City Council are observed, but <br /> nothing in this section shall prevent the city from enacting or amending official controls to change <br /> the status of conditional uses. <br /> Conditional Use Permit Analysis: The applicant has designed the improvements with screening and <br /> adjacent properties in mind to avoid negative impacts. Each of the project areas have been designed to <br /> conform to the Code requirements. Additionally, the Minnehaha Creek Watershed District is currently <br /> reviewing the project from their rule perspective. The project appears to trigger the District's erosion <br /> control and stormwater rules. The project meets the criteria for the City's CUP review and will be <br /> expected to comply with MCWD permitting rules as well. <br /> • <br /> Public Comments <br /> Received public comments are attached as Exhibit G. The applicant's responses to the comments were <br /> incorporated in the project summary description on Page 3. <br /> Issues for Consideration <br /> 1. Does the Commission find it necessary to impose conditions in order to mitigate the <br /> impacts created by the granting of the request? <br /> 2. Are there any other issues or concerns with this application? <br /> Planning Staff Recommendation <br /> Planning Staff recommends approval of the CUP to proceed with the projects as proposed.
