The City Council finds that the conditions e�isting on this property are <br /> peculiar to it and do not apply generally to other property in this zonin� <br /> district; that granting the variance would not adversely afFect traffic. <br /> conditions, liQht, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and ���ould be in <br /> keeping with the spirit and ii�tent of the Zoning Code. and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER ANI) CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Cauncil hereby <br /> grants a variance to Orono 1��Iunicipal Zoning Code Section 78-1288 Subdivisions A and <br /> B and Section 78-1403 to allow structure closer to the lake than 75'; 3?.9% hardcover <br /> where 0% is normally allowed and 32.6% currently eYists within the 0 — 7�' zone; 29.�% <br /> hardcover where 2�% is normally allowed and 31.4% currently e�ists within the 75' — <br /> 250' zone; and 21% stnictural covera�e where 15% is allowed and 21.5% currently eaists <br /> in order to construct an attached �arage to the e�istin� home, subject to the following <br /> conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and <br /> annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require further Plannina Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall not increase above the leti�el of 3,49� s.f. or <br /> 32.9%. Hardcover in the 75-250' zone shall be limited to 624 s.f. or ?9.�% per <br /> the proposed plan and hardcover allowance summary as depicted on E�:hibit A. <br /> Applicant is advised that any future requests to increase hardcover or change the <br /> nature of e.xistina/approved hardcover shall require City approval, anu inc.reases <br /> in hardcover ���ill not likely be approved ���ithout concurrenj reduction in existing <br /> hardcover. <br /> 3.
